By accessing and using the Shadow Themes website (“we”, “us”, “our”) or purchasing our digital products (HTML templates, WordPress themes, Framer templates), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or purchase our products.
2. Merchant of Record & Purchases
Our checkout and order fulfillment services are operated by third-party Merchant of Record platforms:
- Envato Market: Purchases made via Envato are subject to Envato’s terms and conditions.
All billing inquiries and payment handling are subject to the respective platform’s terms.
3. Intellectual Property & Licensing
All templates, graphics, code base, and design assets hosted on or sold through Shadow Themes are the exclusive intellectual property of Shadow Themes (operated under Ukrainian law).
- Permitted Use: Purchasing a product grants you a non-exclusive, non-transferable license to use the item for your personal or commercial client projects in accordance with the license tier selected during purchase.
- Restrictions: You may not sub-license, resell, share, redistribute, or offer our templates (modified or unmodified) on any marketplace, repository, or public platform.
4. Refunds and Returns
ThemeForest purchases follow Envato’s standard refund policy, where undownloaded item may be eligible for a refund according to their terms.
5. Technical Support & Updates
We provide technical support for bugs and core functionality related to our items. Support does not cover custom feature development, extensive code modifications, or third-party plugin integration conflicts. Product updates are provided at our discretion to maintain software compatibility.
6. Limitation of Liability
Shadow Themes products are provided “as is” without warranty of any kind, express or implied. In no event shall Shadow Themes be liable for any damages (including, but not limited to, lost profits, business interruption, or loss of data) arising out of the use or inability to use our products.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles.
